These Entry Terms and Conditions (“Terms”) form a binding agreement between you (“the Entrant”) and Harties Trail Experience (Pty) Ltd (“the Organiser”) when you enter THE 99. By completing entry and payment, you accept these Terms in full, together with the Event Rules and Privacy Policy published alongside them.

1. Eligibility

  1. You must be 18 years of age or older as at the date of the event to enter. Entry will be refused, and any payment reversed, if this requirement is not met.
  2. You must provide accurate personal information at entry, including your full name, ID number and date of birth, for verification purposes.

2. Entry process, queue, and payment

  1. Entry to THE 99 is by way of a single ordered queue. There is no direct way to secure a confirmed spot without first joining the queue.
  2. Joining the queue costs R99, payable via Paystack at the time you join. This fee is strictly nonrefundable under all circumstances, including if you are never invited to confirm a spot.
  3. Once entries open, the first 99 people in the queue, by queue position, are invited by email, in order, to pay the remaining R900 within 48 hours to secure a confirmed spot. If you do not pay within that window, your invitation lapses and passes to the next person in the queue. You remain in the queue and may be invited again if a further spot opens up.
  4. If you are invited and pay the R900 balance within the window, your total payment of R999 secures your confirmed entry. The R99 already paid is credited toward this amount. You are never charged the full R999 again on top of it.
  5. If you have not been invited by the time entries open, you remain in the queue in your existing position and will be invited in order as spots become available, including from cancellations described below.

3. Refunds and resale

  1. The R99 queue fee is nonrefundable in all circumstances.
  2. Once confirmed, if you withdraw before 1 December 2026, the Organiser will refund up to 80% of the R999 entry fee (a maximum of R799.20). The exact refund amount is at the Organiser's discretion up to this cap and may account for non-recoverable payment processing costs.
  3. If you withdraw on or after 1 December 2026, no refund is due.
  4. Whether or not a refund is issued, the Organiser may resell a spot released through withdrawal by inviting the next person in the queue. Any resale amount belongs solely to the Organiser.
  5. An entrant who does not formally withdraw in advance forfeits their entry in full. No refund is due.
  6. Self-substitution is not permitted. All cancellations and resales are handled exclusively through the Organiser's queue and refund process.

4. Assumption of risk

  1. THE 99 is a multi-lap trail endurance event that takes place over difficult terrain, potentially including darkness and conditions of significant physical fatigue.
  2. You acknowledge that trail running and ultra-endurance events carry inherent risks, including falls, collisions, adverse weather, exhaustion, dehydration, injury and, in rare cases, serious injury or death.
  3. You enter and participate entirely at your own risk. By entering, you confirm that you have made a self-declared assessment of your own fitness and health, and that you believe yourself capable of undertaking this event. The Organiser does not require, and has not obtained, medical certification of your fitness.
  4. To the fullest extent permitted by law, you release and indemnify the Organiser, its directors, employees, marshals, volunteers, sponsors and production partners from any claim, liability, loss or damage arising from your participation, except where liability arises from the gross negligence or wilful misconduct of the Organiser.

5. Elimination format

  1. You acknowledge and accept the elimination format described in the Event Rules, including that you may be removed from the event at the close of any lap, and that the Organiser's timing and determination of lap order is final and not subject to appeal.

6. Media and livestream consent

  1. THE 99 is filmed and livestreamed in full, including drone footage and on-camera interviews.
  2. By entering, you consent to being filmed, photographed and interviewed before, during and after the event, and to that footage being broadcast live and used afterward by the Organiser and its production partners for promotional, editorial, commercial and archival purposes, without further compensation to you.
  3. You consent to a public profile page being published on the event website using the bio, running history, race history, Instagram handle and photo you provide at entry, for so long as reasonably necessary for event storytelling and archival purposes.

7. Cancellation or postponement

  1. If the Organiser cancels or postpones the event due to circumstances beyond its reasonable control, including extreme weather, safety concerns or force majeure, the Organiser will communicate this to entrants as soon as reasonably possible. Whether any refund, credit or alternative arrangement is offered is at the Organiser's sole discretion.

8. Disqualification

  1. The Organiser may disqualify any entrant, at any stage, for conduct that breaches the Event Rules, poses a safety risk or involves dishonesty in the entry process, including false information provided at entry. No refund is due in the event of disqualification.

9. Governing law

  1. These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your participation in THE 99 is subject to the jurisdiction of the South African courts.

10. Changes to these terms

  1. The Organiser may update these Terms from time to time. The version in force at the time of your entry governs your participation.

These Terms have not yet been reviewed by a lawyer. Legal review before publishing is strongly recommended, particularly for the liability waiver, self-declared fitness basis and nonrefundable payment structure.
