Entry terms
and conditions.

These Entry Terms and Conditions (“Terms”) form a binding agreement between you (“the Entrant”) and Harties Trail Experience (Pty) Ltd (“the Organiser”) when you enter THE 99. By completing entry and payment, you accept these Terms in full, together with the Event Rules and Privacy Policy published alongside them.

1. Eligibility

  1. You must be 18 years of age or older as at the date of the event to enter. Entry will be refused, and any payment reversed, if this requirement is not met.
  2. You must provide accurate personal information at entry, including your full name, ID number and date of birth, for verification purposes.

2. Entry fee and payment

  1. The standard entry fee is R999, payable in full at the time of entry via Paystack.
  2. Once 99 confirmed entries are reached, entry closes to the waitlist. Waitlist entry costs R99, charged at the time of joining the waitlist.
  3. The R99 waitlist fee is strictly nonrefundable under all circumstances, including if you are never promoted from the waitlist.
  4. If a waitlisted entrant is later promoted to a confirmed spot, the R99 already paid is credited toward the full entry fee, and the entrant pays the remaining R900 to secure their place. This balance must be paid within the notice period communicated at the time of the promotion offer, failing which the offer lapses and passes to the next waitlisted entrant.

3. Refunds and substitution

  1. The R999 entry fee is non-refundable in all circumstances, including withdrawal, injury, illness or inability to attend.
  2. Self-substitution is permitted if you are unable to run, subject to the Organiser's substitution process and any deadline communicated ahead of the event. The substitute must independently meet all eligibility and entry-information requirements.
  3. The Organiser does not facilitate resale of entries and is not responsible for any private arrangement between an entrant and a substitute.

4. Assumption of risk

  1. THE 99 is a trail endurance event that takes place over difficult terrain, over an extended period of up to approximately 24 hours, including during darkness and under conditions of significant physical fatigue.
  2. You acknowledge that trail running and ultra-endurance events carry inherent risks, including falls, collisions, adverse weather, exhaustion, dehydration, injury and, in rare cases, serious injury or death.
  3. You enter and participate entirely at your own risk. By entering, you confirm that you have made a self-declared assessment of your own fitness and health, and that you believe yourself capable of undertaking this event. The Organiser does not require, and has not obtained, medical certification of your fitness.
  4. To the fullest extent permitted by law, you release and indemnify the Organiser, its directors, employees, marshals, volunteers, sponsors and production partners from any claim, liability, loss or damage arising from your participation, except where liability arises from the gross negligence or wilful misconduct of the Organiser.

5. Elimination format

  1. You acknowledge and accept the elimination format described in the Event Rules, including that you may be removed from the event at the close of any lap, and that the Organiser's timing and determination of lap order is final and not subject to appeal.

6. Media and livestream consent

  1. THE 99 is filmed and livestreamed in full, including drone footage and on-camera interviews.
  2. By entering, you consent to being filmed, photographed and interviewed before, during and after the event, and to that footage being broadcast live and used afterward by the Organiser and its production partners for promotional, editorial, commercial and archival purposes, without further compensation to you.
  3. You consent to a public profile page being published on the event website using the bio, running history, race history, Instagram handle and photo you provide at entry, for so long as reasonably necessary for event storytelling and archival purposes.

7. Cancellation or postponement

  1. If the Organiser cancels or postpones the event due to circumstances beyond its reasonable control, including extreme weather, safety concerns or force majeure, the Organiser will communicate this to entrants as soon as reasonably possible. Whether any refund, credit or alternative arrangement is offered is at the Organiser's sole discretion.

8. Disqualification

  1. The Organiser may disqualify any entrant, at any stage, for conduct that breaches the Event Rules, poses a safety risk or involves dishonesty in the entry process, including false information provided at entry. No refund is due in the event of disqualification.

9. Governing law

  1. These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your participation in THE 99 is subject to the jurisdiction of the South African courts.

10. Changes to these terms

  1. The Organiser may update these Terms from time to time. The version in force at the time of your entry governs your participation.

These Terms have not yet been reviewed by a lawyer. Legal review before publishing is strongly recommended, particularly for the liability waiver, self-declared fitness basis and nonrefundable payment structure.
